Art Gallery Society of NSW terms and conditions

(a) By becoming a member of the Art Gallery NSW or renewing your membership, you are automatically agreeing to these terms and conditions. 

(b) The Art Gallery Society of New South Wales (AGS) manage the membership program for the Art Gallery of New South Wales (AGNSW or the Gallery).

(c) References to the "AGS", "we" or "us" are references to the Art Gallery Society of NSW. 

(d) By becoming a member, a legally binding contract will be formed between us, and the following terms and conditions will form the basis of that contract through which the AGS will deliver a service to you as a member. Where you apply for gift membership for someone else, we will deliver these services to the person who redeems the membership.

1. Membership benefits

1.1 Members of the AGS (members or membership as context requires) will receive a range of benefits dependent on the category. Membership benefits can be found on the Gallery website at https://www.artgallery.nsw.gov.au/members/become-a-member/

1.2 The AGS reserves the right to change or withdraw the benefits that apply to members at any time and without prior notice. This includes access to the Members Lounge. Where possible, changes to benefits will be published on the Art Gallery of NSW website or via the e-newsletter.

1.3 Any third parties or external providers of a benefit provided to members and included in the membership package, will have absolute discretion in relation to the provision of services.

1.4 Services supplied from a third party or an external provider will be subject to the supplier’s own terms and conditions. The AGS is not responsible for and does not accept any liability for loss or damage suffered as a result of a fault, error or omission in the provision of these services.

1.5 The Art Gallery NSW member discount is available for exhibitions, events and selected outlets at the Art Gallery of NSW. The members discount may not be applicable on all items.

1.6 Art Gallery NSW membership (other than gift membership – see clause 10 below) is valid from the date of acceptance by the Gallery. The date of expiry is included on the membership confirmation documentation and can also be viewed by logging into the ‘Renew membership’ page on the AGNSW website.

2. Administration of your membership

2.1 Art Gallery NSW membership is administered almost exclusively through online channels.

2.2 memberships can only be administered online by using the primary member details, this includes booking exhibition tickets.

2.3 When you join as a member, you will be asked for your email address which will be used to send you confirmation of payments and emails regarding your membership including gallery news, events and exhibitions. Members will also be sent reminders regarding their benefits, membership renewal notifications, surveys and appeals. 

2.4 You can unsubscribe from emails at any time using the link included on all email updates which we send you. 

2.5 If you choose not to provide an email address (or you unsubscribe from receiving emails from us at any time) the only communications you will receive from us will be those very limited communications which we send by post, including the welcome pack and a postal reminder about renewal. 

2.6 Members who choose not to provide an email address acknowledge and accept that they will not receive correspondence regarding special offers and events and may miss the opportunities related to their membership benefits.

2.7 The AGS does not have control over individual email servers and accounts and is not responsible for the receipt of member emails. Members who notice that they are not receiving emails should notify the AGS immediately. Members must take responsibility to read their emails in a timely manner. The AGS will not be held responsible for missed opportunities due to members not reading their emails.

3. Member cards

3.1 Members are asked to produce their membership card (physical or digital) or membership confirmation email with a temporary member card with a barcode / QR code when they visit the Gallery. Member cards must be produced and scanned to gain access to the Members Lounge.

3.2 Membership cards are for the named card holder only. Memberships may not be transferred to another person and members are not permitted to allow another person to use their membership card.

3.3 If requested by a member, a physical membership card will be dispatched within fifteen (15) working days of your application for membership being accepted by the Gallery. Digital member cards are included in confirmation emails at point of sign up and can be used immediately.

3.4 Lost physical membership cards will be replaced once free of charge. Any subsequent replacement cards may incur a small administrative fee.

4. Accessing ticketed exhibitions 

4.1 The Gallery operates a timed ticket system for entry to ticketed exhibitions to monitor Gallery capacity and visitors’ health and safety. Tickets can be booked either:

(a) online at https://www.artgallery.nsw.gov.au/members;

(b) via telephone; or 

(c) in person at the Gallery at the Information Desk (via the members priority queue) or the Members Lounge.

4.2 Members are required to present a valid membership card to book complimentary or discounted member tickets in person at the gallery, or provide full membership details over the telephone.

4.3 Champion members are not required to book tickets and can enter exhibitions by producing their membership card and photo ID at the exhibition entrance. 

4.4 Explore and Connect members can access ticketed exhibitions by purchasing a ticket at the member rate. 

4.5 Inspire members are entitled to one (1) complimentary ticket per member to an exhibition of their choice each year of membership. Additional tickets to ticketed exhibitions are available to purchase at the member rate.

4.6 Complimentary tickets for Inspire members that are not redeemed during the duration of the subscription period will be forfeited and cannot be carried over to the next subscription period.

5. Access to the Members Lounge

5.1 Members are bound by the Members Lounge conditions and entry and use.

6. Right to refuse applications

6.1 The AGS reserves the right to refuse any application for membership in its sole discretion for any reason. The AGS also reserves the right not to fulfil or to cancel a membership if a member is in breach of these terms and conditions.

6.2 On receipt of your order we will accept payment for the price (as applicable). However acceptance of the offer remains subject to approval by the AGS. Once your application has been accepted, a contract will be formed between us. If we cannot accept your application for whatever reason we will notify you and confirm that your account has been re-credited (if applicable).

6.3 If a membership has already been issued to you, your membership card will be deactivated and you will forfeit any membership benefits. A refund will be issued in respect of the remaining months on your membership minus the cost of any exhibition tickets obtained since the membership was issued to you.

7. Price information

7.1 All quoted membership fees are for a one-year or three-year membership subscription.

7.2 We reserve the right to increase the price of your membership subscription on an annual basis. You will be informed of any fee increase within your renewal letter.

7.3 The AGS reserve the right to amend the terms and conditions of this offer at any time and without notice. In any dispute the AGS management’s decision is final.

8. Credit card payments

8.1 The credit card information you provide us for a membership transaction is used solely for the purpose of processing that membership transaction. 

8.2 If you are not using your own credit/debit card to pay for the membership subscription, you must ask permission of the credit/debit card holder before entering payment details. When you subscribe to membership of the AGS either online, by post or verbally, you are confirming that you have obtained the express prior permission of the credit/debit card holder.

9. Auto renew payments

9.1 The AGS will email you fourteen (14) days prior to your auto renew payment being due.

9.2 If there are any changes to the amount or date of your auto renew payment, the AGS will notify you at this time as per clause 9.1.

9.3 If an error has been made as part of the auto renew payment by us, you are entitled to a full and immediate refund of the amount paid.

9.4 You can cancel your auto renew payment at any time by contacting the AGS in writing at least three (3) business days prior to the scheduled date of the payment.

10. Your right to cancel

10.1 As a consumer, you have a legal right to cancel the contract formed between us (and receive a refund of the fees paid) if you change your mind or decide for any other reason that you do not want to continue the membership.

10.2 Your legal right to cancel the contract commences from the start date of your membership subscription. Your deadline for cancelling the contract is fourteen (14) days after the day on which this contract was formed.

10.3 To cancel a contract, you are required to email info@artgallerysociety.org.au or write to membership, Art Gallery Society, Art Gallery Road, Sydney NSW 2000. If you cancel the contract in accordance with clause 10.2 we will:

(a) refund you the price you paid for the membership minus the period of time (if any) that the membership was held prior to your decision to cancel the contract, and the full adult ticket price of any exhibition attended (or booked but failed to attend) prior to cancellation.

(b) process any refunds due to you as soon as reasonably possible.

10.4 After this time there will be no refunds or extensions of membership. Memberships cannot be put on hold.

11. When your membership expires

After the expiry of your membership, you will continue to receive email updates from the AGS to let you know what is happening at the Gallery and provide you the opportunity to renew. If you do not wish to hear from the AGS after your membership expires, you can unsubscribe via the link in the footer in any email from the AGS.

12. Gift membership

12.1 Gift membership must be activated using the unique number issued at the time of purchase. If the unique number is mislaid, the membership cannot be activated. The AGS will not refund gift memberships where the unique number has been lost or mislaid. 

12.2 Gift membership must be activated by the recipient within three (3) years of the original purchase date.

12.3 Refunds are not available for gift memberships that are not activated or any amount not used when redeeming a membership.

13. Data protection and use of personal data

13.1 When you purchase membership (and during your membership subscription, from time to time) it will be necessary for us to obtain from you and process certain information (including, but not limited to, your name, address, contact details, and date of birth), some of which may be 'personal information' for the purposes of the Privacy Act 1988 (Cth). Any personal information that we collect about you will be handled in accordance with the Gallery's privacy policy. You are responsible for reviewing the Privacy Policy periodically and informing yourself of changes to the Privacy Policy.

13.2 In purchasing membership, you consent to the personal information that we collect about you to be passed on to relevant persons or entities – such as our associated entities, service providers, or third-party suppliers – to enable us to manage your membership and any associated activities and, if you opt in, to send you marketing communications. 

14. Events

14.1 Members will have access to a programme of events organised by the AGS. Most events are an additional cost to the membership fee. 

14.2 Tickets to events are available to members at a discounted rate.

14.3 Events are limited by capacity which will vary according to event. Therefore, attendance cannot be guaranteed to all members and advance bookings are recommended.

14.4 Unless otherwise advised, tickets for both the free and paid events are available on a first-come, first-served basis via the ticketing pages on the website. Members will be asked to log into their account to identify themselves as a member. 

14.5 The AGS reserves the right to cancel or rearrange an organised event.

14.6 Member’s tickets for paid events are non-refundable unless the event has been cancelled by the AGS or postponed to a date that is not suitable for the attendee.

14.7 The AGS does not accept liability for any costs incurred (e.g. travel) by members if the Gallery has to cancel an event due to unforeseen circumstances. 

14.8 Members with bookings to free events who cannot attend must contact the membership team as soon as possible, so the place can be made available to another member.

15. Donations

15.1 The Art Gallery Society of NSW is endorsed by the Australian Tax Office as a deductible gift recipient.

15.2 Donations of $2 or more are generally tax deductible. You should however seek your own tax advice.

15.3 Donations of $200 or more entitle you to become a member of the Collection Circle and receive invitations to exclusive unveilings.

15.4 Subscription to direct debit donations are ongoing until cancelled by you or the Society.

15.5 Donations are not refundable.

16. Travel and Luxury draw

16.1 Specific terms and conditions apply to the Travel and Luxury Draw.

18. General

These terms and conditions together with your application for membership set out the whole of our agreement relating to the supply of membership services by us to you. Nothing stated by any sales person or member of our Visitor Engagement team on our behalf should be understood as a variation of these terms and conditions or as a representation about the nature and quality of the services being offered by us.

19.1 Members accept the conditions of entry of the Art Gallery of NSW. Refunds or extension of membership will not be offered if a member does not qualify for entry into the Gallery.

19.2 If a member is found in breach of the conditions of entry, their membership may be suspended or cancelled.

19.3 NSW public health orders due to pandemics or other emergencies may restrict access to the Gallery to members and the public. Refunds or extension of membership will not be offered if access to the Gallery is restricted due to public health orders. However, the AGS will make every effort to provide online content for members to access. 

20. Members behaviour

20.1 Members and guests must respect each other and staff. Aggressive and unacceptable behaviour will not be tolerated and members or guests that infringe the policies of the Art Gallery of NSW may be removed from the venue.

20.2 More serious offences will also be referred to the AGS Council and may lead to suspension or cancellation of membership.
